General Terms and Conditions for the Käpsele Innovation Festival
1 Organiser and scope of application

Hereinafter referred to as the Organiser.
The following GTC in their current version apply to the contracts concluded with the organisers (IHK Südlicher Oberrhein and Freiburg Wirtschaft Touristik und Messe GmbH & Co. KG) for participation in the event "Käpsele Innovation Festival".
By purchasing a ticket, the participant accepts the General Terms and Conditions of the organisers. Deviating regulations of the contractual partners do not apply unless the organisers have confirmed this in writing.
2 Registration and order confirmation
Registration for participation in events takes place online via the vivenu portal. The registration deadline can be found in the digital event information on the event website. Registrations are generally considered in the order in which they are received until the maximum number of participants specified by the organisers has been reached. Registration is a binding contractual offer. The contracting parties are the organisers and the participant. If the participant registers through a third party, the registering third party is the contracting party. The contract is accepted by means of an automatically generated registration confirmation and automatically generated ticket.
The following (personal) data is collected during registration, stored and used for the preparation, implementation and follow-up of the event: salutation, title, first name, surname, company/institution, e-mail, street and house number, postcode, city. The event's data protection regulations apply to all personal data. By registering, participants expressly agree to the use described.
3 Terms of payment, costs, cancellation
Tickets can only be purchased via the vivenu portal. The price stated in the ticket portal only includes the services described in more detail in the invitation text, on the event website and in the vivenu ticket shop. The prices stated in the application are net prices and must be paid in accordance with the specified terms of payment. The statutory value-added tax will be added to the ticket price. The ticket cannot be cancelled.
4 Cancellation or change of the event
The organisers reserve the right to postpone or cancel the event for reasons for which they are not responsible (e.g. due to force majeure, illness of several speakers without the possibility of replacement or insufficient number of participants). The participant(s) will be informed immediately using the contact details given in their registration. If the event cannot take place, participants will be refunded the ticket price. There are no further claims.
5 Travel - overnight stays - accommodation
Travel and accommodation are not included in the ticket price and must be organised/booked by the participants themselves.
6 Liability
Claims for damages by the participant are excluded. Excluded from this are claims for damages by the participant arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by the organisers, their legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. In the event of a breach of material contractual obligations, the organisers shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the participant's claims for damages are based on injury to life, limb or health.
7 Photography and filming
Photographs and films will be taken during the event for the purposes of documentation, public relations and advertising. The recordings will be used in press releases and print media, on the organiser's website and social media channels. In addition, selected image and video material will be used to promote upcoming events. Within the scope of these purposes, the
organisers also pass on the recordings to third parties (e.g. press companies, sponsors, speakers and cooperation partners).
The participant may be recognisable in the photographs and film footage. By registering and purchasing a ticket, the participant agrees that photographs and film footage may be stored, used and published for the purposes described above.
In this context, participants waive any payment of fees and make no claims in connection with the use of their photographs.
Photo or film permission is not a prerequisite for participation in the event. The organiser can be contested in writing by email.
The legal basis for this is the organiser's legitimate interest in public relations work for the event and documentation of the offer and service; Art. 6 para. 1 sentence 1 lit. fEU-DSGVO. The images are used for the duration of the communication measures or for permanent archiving. The image databases are regularly updated and images that are no longer required are deleted.
As a participant, you are hereby informed of your legal rights: You can lodge an objection in accordance with Art. 21 EU GDPR; request information in accordance with Art. 15 EU GDPR, request rectification or completion in accordance with Art. 16 EU GDPR, request erasure in accordance with Art. 17 EU GDPR, request erasure, pursuant to Art. 18 EU GDPR, request restriction of processing, pursuant to Art. 20 EU GDPR, request transmission, pursuant to Art. 77 EU GDPR, lodge a complaint with a supervisory authority. Further information can be found in the data protection provisions for the event.
8. note on light and strobe effects
Light, colour and strobe effects may be used during the event. These may cause adverse health effects in certain people, particularly those with existing light sensitivity, epilepsy or similar health conditions. Participation in the event is therefore at the participant's own risk. It is the responsibility of the participants to check their own health suitability for attending the event. Any liability on the part of the organiser for damage to health resulting from the use of the aforementioned light and stroboscope effects is excluded to the extent permitted by law.
9 Newsletter
By registering, participants agree to be included in an event-specific newsletter, which will be used for information purposes
e.g. on the programme, travel options, thematic content, organisational matters.
10. exhibitions/event elements from partners
Separate regulations may apply to any trade exhibitions or other event elements accompanying the event.
11. copyrights
Contents of the event, e.g. contents of speakers, may be protected by copyright. Any type of reproduction, forwarding to third parties or other use that goes beyond the personal information of the participants requires the prior written consent of the organisers.
12 Data protection
The data protection regulations of the event apply.
Cancellation policy
You have the right to cancel this contract within 14 days of conclusion of the contract without giving reasons.
To exercise your right of cancellation, you must notify the organiser (representative contact: Freiburg Wirtschaft Touristik und Messe GmbH & co.KG, Neuer Messplatz 3, 79108 Freiburg, kontakt.info@fwtm.de, 0761 3881-01, www.fwtm.freiburg.de) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to cancel this contract. You can use the following sample cancellation form, although this is not mandatory. The cancellation period is fourteen days from the date of conclusion of the contract.

If you withdraw from this contract, the organisers shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
cancellation of this contract has been received by us. For this repayment, the
Organiser will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
If you have requested that the services should commence during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.
